Johnny Depp’s legal team have shown a video they say was provided by an “anonymous source” which shows Amber Heard “attacked” her sister, London’s High Court has heard.
On Friday, lawyer for Depp, 57, David Sherbourne, told the court his team had received a video from a “confidential source” that made up part of the out-takes of a reality television show.
The video shows Heard’s sister, Whitney Henriquez, poolside with two friends being asked by one if she “got into a fight or something?” as the woman appears to inspect her cheek and arm.
Another woman describes it as an “altercation” and Henriquez said they had “already talked about. Won’t talk about it anymore.”
The first woman says “I can’t believe Amber beat your ass. I know you could beat her ass,” before Henriquez says again, “we’re not gonna talk about that.”
The woman presses further to say: “Whitney truth or dare? Did you really start the fight with your sister? Or did she start it? For real for real for real.”
“We’re not gonna talk about that,” she replies.
“She really did woop your butt,” the woman continues, before Heard shuts down the conversation saying “Oh we are not talking about it.”

In an exchange over whether the video was admissible, Sherbourne told the court it was “quite clear from that video that not only did Ms Amber Heard assault her sister, but it was quite clear also that the injuries that were suffered by Ms Whitney Heard are being examined by the individual that we see on the tape,” using Whitney Henriquez’s maiden name of Heard.
“There is no denial of the fact that Ms Amber Heard ‘beat up’ Ms Whitney Heard and that there are injuries,” he said.
However News Group Newspapers lawyer Sasha Wass, acting for publishers of The Sun, said the video was an “undated piece of film footage in circumstances which appear to be some sort of reality TV program, which is flippant, certainly not serious.”
She added: “This is a lighthearted exchange, there is no evidence of any injuries and it will take the matter … no further.
“We say this is not only late disclosure, it is meaningless.”
Judge Nicol allowed the video and Henriquez was later questioned about it by Eleanor Laws, QC, also acting for Depp, who quizzed her on what she was being asked about.
Ms Henriquez replied: “We were referencing a verbal argument my sister and I had got into the night before.”
Ms Laws said it was “a real argument that, in fact, you must have described to them off camera”, to which Ms Henriquez said: “I didn’t discuss anything other than a verbal argument with my friends off camera.”
Laws insisted it was a “physical fight” but Henriquez said her friends were simply “trying to make a storyline.”
She also denied she had any physical injuries in the clip and said she had no interest in bringing up a fight with her sister.
The surprise video came on the 14th day of the libel case Depp has brought against The Sun’s publishers and its executive editor Dan Wootton over an article referring to him as a “wife-beater”.
He claims he is a Southern gentleman and has never been physically abusive. His ex-wife, Amber Heard, argues that she was beat by him repeatedly during their short-lived marriage.
Both have denied physically attacking the other.
Earlier in the case, Henriquez denied Heard had hit her or that she was “frightened” of her sister.
Amber Heard also previously told the court she hit Johnny Depp once in defence of her sister when she feared he would endanger her life by throwing her down a flight of stairs.
The court also heard how on 22 March 2013, a picture taken showed lines of cocaine on a table next to a tampon applicator.
NGN lawyer Sasha Wass asked if the tampon applicator was used to snort cocaine. Henriquez confirmed it was used and she had taken cocaine with Depp.
Wass asked: “Did the tampon applicator play any part in the occasion when you took cocaine with Mr Depp before March 22?”
Ms Henriquez said: “Yes, the first time I did cocaine with Johnny, I showed him that.” She added: “I gave it to him.”
