An Adelaide man has been found guilty of glassing Australian rap performer MC Pressure at a wake in 2018.
Key points:
- Christopher Peregi was accused of assaulting MC Pressure from the Hilltop Hoods
- Peregi said he tripped on a chair and accidentally smashed the bottle over his head
- A jury found Peregi guilty
A District Court jury took just over two hours to find 45-year-old Christopher Peregi guilty of assaulting Daniel Howe Smith, who goes by MC Pressure in hip hop band the Hilltop Hoods.
During the seven-day trial, Peregi claimed he became lightheaded and tripped on a chair, causing him to accidentally smash the bottle over Mr Smith's head.
He will be sentenced at a later date.
Mr Smith told the jury that he was having a conversation with someone at the wake when Peregi hit him on the head with a glass or a bottle.
"I heard a loud popping sound on my head, felt a hot rush, and my vision went blank and I passed out," he told the court.
"My next memory is being in the melee and being pushed to the front of the property and being asked to leave.
Peregi was acquitted of assaulting the rapper’s older brother, Ross Howe Smith.
Andrew Williams, for Peregi, asked Mr Smith whether his client had in fact fainted, losing his balance, causing him to accidently break the bottle over the victim's head.
But Mr Smith responded: "I'd say it's a pretty outrageous suggestion, that some could accidentally fall against someone, smash a glass over the back of their head until they were unconscious.
It was a 'pure accident'
Peregi told jurors that he was "lightheaded" and as he went to stand up, "my feet got caught in the chair when it moved".
"I wanted to go out and see if Dan was OK and I wanted to just see if he was OK and just say it was a pure accident."
But during her opening address to the jury, prosecutor Carmen Matteo described the incident as purposeful and unprovoked.
She told the jury that they could expect to hear from multiple witnesses during the trial, some of whom would describe Mr Peregi later yelling "Dan was disrespecting me" and "they were laughing at me".
Mr Williams said the group had been drinking from early afternoon and Mr Smith was likely to have been intoxicated when the incident happened.
