Pop star Guy Sebastian's national tour could be impacted by a delay in his former manager's embezzlement trial, the NSW District Court has been told.
Key points:
- Mr Day is standing trial for allegedly embezzling almost $900,000 in payments meant for Guy Sebastian
- The singer has told the court he had trusted Mr Day, who managed him for 10 years
- Mr Day is facing 50 charges and has pleaded not guilty to each count
Sebastian was set to resume giving evidence today at Titus Emanuel Day's trial, but it had to be adjourned due to Judge Peter Zahra falling ill unexpectedly.
The 40-year-old Australian Idol winner is set to perform at the Cairns Convention Centre on Tuesday.
He is due to fly from Sydney on Monday evening but will now have to resume giving evidence on that day.
Judge James Bennett this morning acknowledged the difficult circumstances but said "no other steps can be taken" until Judge Zahra returned.
Mr Day, who managed the singer for a decade, has pleaded not guilty to 50 charges of fraudulent embezzling and 50 alternative charges of larceny or stealing.
Police allege the celebrity agent stole about $900,000 in royalty, ambassadorship and performance funds from Sebastian between 2013 and 2020.
Yesterday, Crown prosecutor David Morters SC told the court there were "shortfalls" in the amount of money transferred to Sebastian, including hundreds of thousands of dollars he didn’t receive for his support acts for US superstar Taylor Swift's Australian tour in December 2013.
The prosecution also said in some instances no money was paid to Sebastian for his performances, such as his show for the British and Irish Lions rugby tour at Allianz Stadium in the same year.
Defence barrister Dominic Toomey SC yesterday told the jury "there is an answer to every one" of the charges Mr Day is facing and questioned if police may have been influenced by Sebastian's stardom as they investigated his client.
"You may wonder whether authorities or even police were wilfully blind ... seduced by Mr Sebastian's high profile," Mr Toomey told the court yesterday.
The trial will resume on Monday.
